The following terms and conditions contain legal information on your rights under the provisions on contracts in distance selling and electronic business transactions.
1. Scope
These general terms and conditions (GTC) apply to all deliveries by T&T Verlag GbR to consumers (§ 13 BGB). A consumer is any natural person who concludes a legal transaction for a purpose that can neither be attributed to their commercial nor their independent professional activity.
2. Contractual partner
The purchase contract is concluded with T&T Verlag GbR, Stadtplatz 51, 84529 Tittmoning, Germany.
3. Offer and conclusion of contract
The presentation of the products in the online shop is not a legally binding offer, but a non-binding online catalog. Errors excepted. By clicking the “Buy” button, you are placing a binding order for the goods in the shopping cart. The confirmation of receipt of your order takes place together with the acceptance of the order immediately after sending it by automated e-mail. With this e-mail confirmation, the purchase contract is concluded. We save the contract text and send you the order data by email. You can also view the terms and conditions here at any time. You can see your past orders in our customer area.
4. Right of withdrawal
You can revoke your contract declaration within 14 days in writing (e.g. letter, fax, email) without giving reasons. The period begins after receipt of this instruction in text form, but not before the conclusion of the contract and also not before the fulfillment of our information obligations according to Article 246 § 2 in connection with § 1 paragraph 1 and 2 EGBGB as well as our obligations according to § 312g paragraph 1 sentence 1 BGB in connection with Article 246 § 3 EGBGB. Timely dispatch of the cancellation is sufficient to meet the cancellation deadline.

4.1 Consequences of withdrawal
In the event of an effective cancellation, the mutually received services are to be returned and any benefits (e.g. interest) surrendered. If you are unable or partially unable to return or surrender the received service and benefits (e.g. benefits of use) or only in a deteriorated condition, you must compensate us for the value. You only have to pay compensation for the deterioration of the item and for any benefits drawn if the use or deterioration is due to handling of the item that goes beyond checking the properties and functionality. “Checking the properties and functionality” means testing and trying out the respective goods, as is possible and customary in a shop. Transportable items are to be returned at our risk. You have to bear the regular costs of returning the goods if the goods delivered correspond to the goods ordered and if the price of the goods to be returned does not exceed an amount of 40 euros or if you have not yet received the consideration or a have made the contractually agreed partial payment. Otherwise, the return is free for you. Items that cannot be sent as a parcel will be picked up from you. Obligations to reimburse payments must be fulfilled within 30 days. The period begins for you when you send your declaration of cancellation or the goods, for us with their receipt.
4.2 Special notes
Your right of withdrawal expires prematurely if the contract has been completely fulfilled by both parties at your express request before you have exercised your right of withdrawal. If the customer buys as an entrepreneur in the exercise of his independent or commercial activity or if he uses the purchased product commercially, he is not entitled to the right of withdrawal. The right of revocation does not exist in the case of distance sales contracts for the delivery of audio or video recordings or software, provided that the delivered data carriers have been unsealed by the consumer. The right of withdrawal does not apply to distance contracts for the delivery of goods that are made to customer specifications or that are clearly tailored to personal needs.
4.3 Return costs when exercising the right of withdrawal
If you make use of your statutory right of cancellation (see cancellation policy), you have to bear the regular costs of returning the goods if the goods delivered correspond to the goods ordered and if the price of the goods to be returned does not exceed an amount of 40 euros or if you pay a higher price have not yet provided the consideration or a contractually agreed partial payment for the item at the time of revocation. Otherwise, the return is free for you.
5. Prices and Terms of Payment
The prices shown on the T&T Verlag GbR website at the time of the order apply. All prices mentioned are final prices in euros. The prices stated on the product pages include the statutory value added tax and other price components. Obvious price errors reserved. Packaging and shipping costs are charged separately. The shipping costs are clearly communicated to you on the product pages, in the shopping cart system and on the order page. T&T Verlag GbR accepts all payment methods offered on its website during the ordering process. The customer chooses his preferred payment method himself.
6. Delivery, delivery times and shipping costs
The goods are delivered to the customer by the third-party providers (delivery services) specified during the ordering process. The customer chooses his preferred shipping method himself. The shipping costs are announced to the customer before the ordering process is initiated within the shopping cart. Goods in stock are dispatched within three working days of receipt of the order. For goods that are not in stock, the delivery time can be up to four weeks after receipt of the order.
7. Transfer of risk (not applicable if you take out insurance)
The delivery of the goods takes place at the risk of the customer. The risk is transferred to the customer when the goods are handed over to the transport company. This also applies if T&T Verlag GbR has assumed the transport costs. Complaints about transport damage (e.g. damaged packaging on receipt of the goods) must be made directly to the transport company by the customer within the deadlines provided for this.
8. Guarantee
T&T Verlag GbR guarantees that the goods sold are free of material and manufacturing defects at the time of the transfer of risk and that they have the contractually guaranteed properties. The statutory warranty period of two years from the date of invoicing applies. The guarantee does not extend to normal operational wear and tear or normal wear and tear. Claims of the customer for damages, e.g. due to non-performance, negligence when concluding the contract, breach of secondary contractual obligations, consequential damage due to defects, damage from tort and other legal reasons are excluded. Except from this, the T&T Verlag GbR is liable in the absence of a guaranteed property, in the event of willful intent or gross negligence. Claims under the Product Liability Act are not affected. If defects occur for which T&T Verlag GbR is responsible, and if the replacement delivery is also defective in the event of the goods being exchanged, the buyer has the right to change or reduce the price. T&T Verlag GbR assumes no liability either for the constant and uninterrupted availability of www.geistigewelt.tv or for technical or electronic errors in the online offer.
9. Retention of title
All deliveries are subject to retention of title. The delivered goods remain the property of T&T Verlag GbR until the purchase price has been paid in full.
10. Place of jurisdiction
The place of jurisdiction for all disputes in connection with the delivery business is, if so agreed, the place of jurisdiction of T&T Verlag GbR. The registered office of T&T Verlag GbR is agreed as the place of jurisdiction in the event that the contractual partner does not have a general place of jurisdiction in Germany or the contractual partner relocates abroad after the conclusion of the contract or the contractual partner’s place of residence is not known at the time the action is brought. With regard to all legal relationships arising from this contractual relationship, the contractual partners agree to apply the law of the Federal Republic of Germany to the exclusion of the UN Sales Convention.
11. Additional provision
The invalidity or ineffectiveness of individual provisions of these terms and conditions does not affect the validity of the remaining provisions. Invalid or ineffective conditions are replaced by the statutory provisions.
12. Copyright
The images used in the products are license-free images. If the products contain images or graphics from third-party services, T&T Verlag GbR has acquired appropriate licenses for them. T&T Verlag GbR owns the copyrights to all products offered in the T&T Verlag GbR online shop. These remain permanently with T&T Verlag GbR. The customer is expressly prohibited from any type of reproduction, processing, distribution or any type of exploitation outside the limits of copyright law.
